Terms of Service

This is a courtesy translation. The German version is the legally binding document.

1. Scope

These Terms of Service apply to the use of the XHR Network platform (xhr.network, app.xhr.network, pro.xhr.network), operated by ASCEND GmbH, Kaiserstraße 5, 40479 Düsseldorf, and all associated services. By registering, you agree to these terms.

2. Service Description

XHR Network offers:

• AI-powered health analyses based on uploaded documents
• Secure doctor-patient communication (chat, video)
• Appointment booking and management
• Health data tracking and visualisation
• Genomic analysis (within the Plus plan)

4. Registration and Account

• You must be at least 18 years old
• You are responsible for the accuracy of your information
• Your password must be kept confidential
• Sharing your account with third parties is prohibited
• Multi-factor authentication is recommended

5. Free and Paid Services

5.1 Free Plan

The free plan includes AI analyses, risk scores, document upload, appointment booking, and doctor-patient connections.

5.2 Plus Plan (€4.90/month)

Additionally: genomic analysis (WGS), enhanced AI models, priority support, video consultations. Billing is processed monthly via Mollie.

5.3 Cancellation

The Plus plan can be cancelled at any time, effective at the end of the current billing period. Amounts already paid will not be refunded.

6. Privacy

The processing of personal data is governed by our Privacy Policy. Health data is processed exclusively on German servers and is not shared with third parties.

7. User Obligations

• No misuse of the platform
• No uploading of unlawful content
• No automated access (scraping, bots)
• Compliance with medical confidentiality (for providers)

8. Limitation of Liability

ASCEND GmbH (operator of XHR Network) is not liable for:

• Damages caused by incorrect AI analyses or risk scores
• Decisions made based on the information provided
• Service outages or interruptions
• Data loss due to force majeure

Liability for intent and gross negligence remains unaffected.

9. Intellectual Property

All platform content (text, code, design, logos) is protected by copyright. Your uploaded health data remains your property.

10. Termination and Data Deletion

You can delete your account at any time. Upon account deletion:

• All personal data will be deleted within 30 days
• Backups will be overwritten within 30 days
• Anonymised, aggregated data may be retained for research purposes

11. Governing Law

The laws of the Federal Republic of Germany apply. The place of jurisdiction is Düsseldorf.

12. Amendments

We reserve the right to amend these Terms of Service. You will be notified of material changes by email. Continued use after notification constitutes acceptance.
